Senate Minority Leader Mitch McConnell believes former President Donald Trump committed no crime at the Jan. 6 Save America Rally that preceded the Capitol riot when he told protesters to “peacefully and patriotically make your voices heard”; that holding the Senate trial after Jan. 20 that McConnell himself postponed was unconstitutional; but that Trump can still be held criminally or civilly liable for the Jan. 6 riot. But, if McConnell, who voted not guilty, does not think any crime was committed by the “strict criminal standard,” why would he suggest that that Trump should be held accountable by the criminal or civil justice system?

A Rio Grande Valley, Texas resident is worried that her community could be endangered when President Biden’s Department of Homeland Security releases migrants into her local communities. She says they haven’t been vetted and they could have criminal records. She even calls for a state of emergency to be declared!

Former President Donald Trump has once again been exonerated and found not guilty by the U.S. Senate in his second impeachment trial on all charges that he incited the Capitol riot on Jan. 6 by his speech at the Save America Rally when in fact he urged protesters to “peacefully and patriotically make your voices heard.” Presumably, now is the time for the country to move forward from the Trump presidency, independent of whether Trump decides to remain involved in national politics, including in the 2022 Congressional midterms or in 2024 if he decides to once again challenge President Joe Biden when he will be potentially facing reelection. For now, it is clear that whether or not Trump decides to run for president again, it will be the American people — and not the U.S. Senate — who decides his fitness for office. Nobody should be surprised at this outcome as the Jan. 6 speech was constitutionally protected by the First Amendment. In Brandenburg v. Ohio in 1969, the Supreme Court found “the constitutional guarantees of free speech and free press do not permit a State to forbid or proscribe advocacy of the use of force or of law violation except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.” In that case, mere advocacy of violence or lawless action was not enough to sustain a conviction and at the Jan. 6 speech, there was no such advocacy, thus failing the Brandenburg test. This is a victory for free speech. The House simply could not prove its case, because once again, there was no crime, and nobody can be impeached and convicted without a crime. What do you think?

More bad news for the fake news network CNN – their ratings have cratered under a Biden presidency. With today’s ALG Minute, I’m Catherine Mortensen. In the first week of Biden in office, ratings dropped about 44 percent during primetime compared to the previous week. While it’s too early to conclude any longer-term direction for news ratings after just one week, the downturn could be interpreted as an indicator of what many industry observers had anticipated: With Biden in the White House, networks that have spent the last four years railing consistently against Trump have lost the main attraction that energized their audience bases, making it difficult to hold onto the elevated viewing levels. Trump was the best thing to ever happen to CNN. They’ll have to figure out a new business model going forward – find a new bogey man. And I suspect with Trump out of office, you and I will be their target – they will seek to vilify us every day by calling us terrorists and insurrectionists.

The cancel culture strikes out at the Christian group – Focus on the Family. With today’s ALG Minute, I’m Catherine Mortensen. Twitter recently locked the group’s account for posting – quote – hateful content. At issue was a Tweet pointing to a story about Dr. Rachel Levine, President Biden’s controversial nominee for Assistant Secretary for Health at the Department of Health and Human Services. The tweet included the following sentence: “Dr. Levine is a transgender woman, that is, a man who believes he is a woman.” According to Twitter, simply acknowledging biological fact is now “hateful.” Others who have found themselves canceled in recent days include former baseball great Curt Schilling who was dropped by his insurance – AIG – because of statements supporting conservative causes. The CEO of Mozilla was ousted after it was discovered he’d given money in support of California’s anti-gay marriage referendum. Martina Navratilova was thrown off an LGBT advocacy board and lost speaking engagements after arguing that transgender male athletes shouldn’t be able to compete in women’s sports. The shoe is on the other foot for Democrats who are trying to hold on to a congressional seat in upstate New York. With today’s ALG Minute, I’m Catherine Mortensen. After more than three months without a certified winner, the state supreme court ruled to certify the election in favor of the republican candidate – with a slim margin of just 109 votes. But the democrat is alleging that “systemic violations of state and federal election law,” make the results unreliable and is considering appealing the certification or possibly contesting the results directly to the House. Incumbent democrat Anthony Brindisi said there should be a recount and audit after what he said were “countless errors and discrepancies” in the initial count. the only way Speaker Pelosi can stop Claudia Tenney from taking office is to validate the same theory Trump used to contest the presidential race – which Pelosi deemed as insurrection. Democrats have taken to twitter to demand a hand recount because they think the voting machines were rigged. Hypocrisy at its worst.
